On Thursday, Cuba Gooding Jr. appeared in a Manhattan Criminal Court for what was supposed to be the beginning of his trial for an incident that occurred back in June, where he had been accused of groping a woman’s breasts in a Manhattan bar. However, the trial was delayed as a new charge was filed against him.
According to the New York Times, the Manhattan District Attorney’s Office said that Cuba was indicted in connection with a second incident, but they did not give any further detail on what he’s being accused of. A spokesperson said the indictment would be unsealed next week. He is now scheduled to appear in court again on Tuesday.
Cuba was scheduled to stand trial over an incident that occurred back in June at the Magic Hour Rooftop Bar in the Moxy NYC Times Square hotel. According to the criminal complaint, Cuba was accused of placing his hand on a woman’s breast and then squeezing without her consent.
He later surrendered to police and was charged with third-degree misdemeanor sexual abuse and forcible touching.
Prior to the trial, his team tried to get the charges dismissed as they enlisted the help from two people who say they were present during the incident, and claim they did not see him touch the woman. He also enlisted the help of a retired officer, who was described in the court papers as an “expert in false reports in sexual assault cases.”
Nonetheless, the judge said, “The conflicting factual allegations between the criminal court information and the defendant’s motion should be resolved at trial.”
At the time of his arrest, police reportedly said they were investigating a second allegation against him that allegedly happened years ago. Police say the woman came forward after seeing news about the incident that occurred in June. However, it is not clear if that investigation is connected to this new charge.
