Last September body camera footage of Rochester police officers’ attempt at arresting Daniel Prude was released. The footage showed the officers pinning him to the ground while he was naked and handcuffed. The officers placed a spit sock over his head as he screamed out until he was no longer breathing.
According to the Associated Press, the officers involved in his death will not face any criminal charges for the incident, which took place last March. The grand jury made the official announcement on Tuesday.
State Attorney General Letitia James spoke about the jury’s decision and said, “The criminal justice system has frustrated efforts to hold law enforcement officers accountable for the unjustified killing of African Americans. And what binds these cases is a tragic loss of life in circumstances in which the death could have been avoided.”
As previously reported, shortly after the video’s release, Rochester’s Mayor Lovely Warren, suspended the seven officers involved in the incident. At that time she had indicated that she was misled by the city’s police chief that Prude had died from an overdose.
Not too long after that, Rochester Police Chief La’Ron Singletary, along with the entire police command staff announced their resignation.
The attorneys for the officers involved in the incident say that their clients were only following their training the night of the incident as they used a restraining method known as “segmenting.” They also claimed that PCP was the cause of Daniel’s behavior that night, which was “the root cause” of his death.
Ultimately, the county medical examiner listed Daniel’s death as a homicide that was caused by “complications of asphyxia in the setting of physical restraint” and cited PCP as a contributing factor.
Elliot Shields, the attorney for Daniel’s family said, “The system failed Daniel Prude again. It failed him on March 22 when he was released from the hospital. It failed him on the night of March 23 when the police use deadly force against him. And it failed him again today.”
