Man Ordered To Pay $65K For A Child That Isn’t His!

A Texas man is fighting the courts over child support payments for a little girl who is not biologically his. Back in 2003, a support court ruled that Gabriel Cornejo would have to cough up child support payments since his ex girlfriend, who has not been named, named him as the father. Then, the state of Texas was granted a default judgement and they began processing funds from Cornejo’s check, but he never contested it.

The only problem is that Cornejo never knew that he could possibly be the father of this child until last year. After submitting to DNA testing, he found out that he wasn’t the father. Unfortunately, he is S.O.L. due to a legal loophole that favors his ex.

The NY Post reports, “Texas’ family code, chapter 161, states that even if one is not the biological father, they still owe support payments that accrued before the paternity test proved otherwise.” That would mean that Cornejo owes about $65,000 for the past 14 years. “I never thought in my whole life I would have to defend myself of something that I am innocent of,” he told #ABC7.

The courts suggest that Cornejo was subpoenaed, but cannot confirm this. Of course, he denies it. That is why he and his legal team are currently trying to persuade a judge to reopen the case since the original court order can’t be amended. If the judge chooses not to reopen the case and Cornejo refuses to pay then he could face jail time.
