Derek Chauvin Reportedly Asks A Judge To Dismiss His Case For The Death Of George Floyd

#Roommates, as he continues to sit in jail for his role in the death of George Floyd, former Minnesota police officer Derek Chauvin now wants all charges against him dismissed. In recent court documents filed on his behalf by his attorneys, Derek Chauvin is asking a judge to dismiss the several felony counts against him regarding George Floyd’s untimely death.

@CNN reports, disgraced former police officer Derek Chauvin has asked a judge to formally dismiss the murder charges against him in the May death of George Floyd. According to official court documents, one of Chauvin’s attorneys states there is not probable cause to support charges of second-degree murder, third-degree murder and second-degree manslaughter.

Additionally, Derek Chauvin also wants Hennepin County Attorney’s Office disqualified, in part because of what his attorney called “an inappropriate, pretrial publicity campaign,” according to the court filing. Meanwhile, the other three former officers involved in George Floyd’s death have also previously filed motions to dismiss the charges against them as well. Judge Peter Cahill, who is presiding over the case, has not yet made any rulings regarding the dismissal requests.

Prosecutors, however, have filed their own motion asking for an “upward sentencing departure” in the cases of Chauvin, J. Alexander Kueng, Thomas Kiernan Lane and Tou Thao. Attorney General Keith Ellison did not define what the request will be, but he told the judge he has reason to go beyond the “sentencing guidelines grid” used in Minnesota to factor in a convicted person’s past criminal history.

“Mr. Floyd was treated with particular cruelty,” prosecutors wrote. “Despite Mr. Floyd’s pleas that he could not breathe and was going to die, as well as the pleas of eyewitnesses to get off Mr. Floyd and help him, Defendant and his codefendants continued to restrain Mr. Floyd.”
