Diddys legal battle has been underway for four weeks. But now, his defense team has reportedly filed a motion for a mistrial. In newly filed court documents, the music moguls legal counsel is accusing prosecutors of misconduct, specifically calling out Cassie and her friend Bryana Bongolans testimonies about an alleged 2016 balcony incident. Diddys lawyers claim the stories dont add up, bringing evidence in new paperwork. Lets break it down…
According to the paperwork, the defense is demanding a mistrial, alleging that prosecutors knowingly used materially false testimony from Cassie and Bryana about an incident where Diddy allegedly dangled Bryana over a 17-story balcony at Cassies LA apartment.
The altercation allegedly took place in September 2016. But Diddys team contends these allegations, stating:
The government has presented testimony that it knew or should have known was materially false Accordingly, to avoid an unfair conviction, the Court should grant a mistrial.
Bryana took the stand on Day 16, claiming that shortly after Diddy showed up at Cassie’s apartment unannounced on September 24, 2016, he allegedly turned physical. S
She recounted wanting to light marijuana when Diddy allegedly threw her over the balcony railing and later tossing her onto patio furniture, leaving her injured. In response, the 55-year-old’s attorney argues the incident couldnt have taken place on that date because Diddy wasnt in LA at the time.
Court records show he was on the East Coast, staying at the Trump Hotel in New York from September 24-29, 2016. Additionally, hes also said to have performed at a Bad Boy reunion tour in Newark while out there. The defense argues that prosecutors let the jury hear Cassie and Bryanas testimony to paint Diddy as a dangerous man.”
The singer testified that she saw Diddy holding Bryana over the balcony, as quoted in the docs filed by his legal team. Cassie said, I saw him bring her back over the railing of the balcony and then throw her onto the patio furniture. However, the defense presented text messages in which the Me & U singer admitted she only heard about the incident from someone else, not that she had witnessed it. Even when confronted with the texts, Cassie doubled down, insisting, I saw what I saw.
But the defense wasnt done, with Bryanas testimony also catching heat. She claimed Diddy held her over a 42-inch railing, with her feet dangling off the balcony, causing her to suffer bruising and pain. However, Diddys team claims thats physically impossible, noting that Diddy, at his height, wouldnt be able to lift a grown woman that high physically. Additionally, Bryana has a $10 million lawsuit against Diddy, which the defense believes gave her a motive to exaggerate.
During Diddys trial, prosecutors introduced images of Bryanas alleged injuries, including a leg bruise that she claimed stemmed from the incident. Bryana testified she snapped the photos the same day as the altercation. When asked where the bruise came from, she responded, saying it stemmed from being thrown onto furniture.
Photos published by TMZ on Saturday, June 7, show said injuries on Bryana’s body, including her neck and her back. Both areas were partially covered up in bandages and patches. It also appeared as if she had a pain relief collar around her neck.
So far, neither Cassie nor Bryana has responded.
