President Joe Biden is making reports just days before his exit from the White House. According to NBC News, the 46th president has commuted the sentences of 2,500 individuals convicted of non-violent drug offenses. Per the outlet, his move is the “biggest single-day act of clemency.”

“This action is an important step toward righting historic wrongs, correcting sentencing disparities, and providing deserving individuals the opportunity to return to their families and communities after spending far too much time behind bars,” President Biden announced.

However, in more shocking headlines, two of the individuals pardoned, Shannon Agofsky and Len Davis, reportedly rejected President Biden’s commutations. Why is that?

Well, The Shade Room’s Correspondent A.B. Burns-Tucker is sharing some answers on ‘TSR Newz.’

Here’s Why Two Death Row Inmates Reportedly Rejected President Joe Biden’s Commutations

According to Burns-Tucker, Shannon Agofsky was sentenced to death in 2004 for the killing of a fellow prisoner. Furthermore, Len Davis, a former Louisiana police officer, was sentenced in 2005 for the killing of a woman who reportedly filed a complaint against him.

Per the reporter, both Agofsky and Davis have filed emergency petitions to prevent their sentences from being commuted to life without the possibility of parole.

“Because both are actively appealing their cases under a claim of actual innocence,” Burns-Tucker explained. “Therefore, reducing their sentences could have an effect on how the courts review their claims.”

More Details On Shannon Agofsky And Len Davis’s Decision

According to the host, the men’s lawyers have argued that their clients did not make these requests. Additionally, changing their sentences “would disadvantage” the men and “harm” their appeals.

Scroll above to watch as Burns-Tucker reveals why else the men rejected President Biden’s gesture. Additionally, the host shares the meaning of the legal term “heightened scrutiny” and why death row cases receive unique treatment.
