Bill Cosby has been locked up in the slammer for almost two weeks now, and his lawyers are already out here trying to get him back home to his family.
According to Page Six, Cosby’s team filed a defense motion on Friday, and are arguing for his 3-to-10-year sentence to be overturned because they claim that there were errors made in his case during the trial.
“The defendant, William H. Cosby, Jr., moves this Court got a new trial in the interest of justice, or at least for reconsideration and modification of the sentence imposed on September 25, 2018” the motion said.
Cosby’s team feels like Judge Steven O’ Neil should’ve removed himself from the case back in 2017 after Cosby’s first mistrial.
“For the reasons derailed in Mr. Cosby’s previously-filed morioka for recusal (which are incorporated here by reference, without being related and set forth at length), and for all the foregoing reasons, a reasonable observer could question the impartially of the judge who imposed the September 25, 2018, sentence. Accordingly, Judge O’Neil should have recused himself from imposing sentence.”
Bill is currently serving his time out at a maximum-security facility in Schwenksville, PA. His team had argued for him to be placed on house arrest before he was sentenced but prosecutors weren’t here for it. They claimed that Bill serving his time at home wouldn’t really be a punishment since he had a lavish birthday party at his home earlier this year.
I guess time will tell if Bill gets out or not!
