Death Penalty? Not So Fast, Says Team Mangione
In court, filings dropped early Saturday morning like a surprise mixtape. And, Mangione’s lawyers asked a New York federal judge to toss out some of the most serious charges he’s facing. That includes the one charge that could land him on death row. Specifically, this is the same charge that came down after U.S. Attorney General Pam Bondi publicly labeled the killing a “cold-blooded assassination” and ordered prosecutors to go for the death penalty back in April. Now, Mangione’s defense says the government is reaching too far — arguing that the stalking charge tied to the case doesn’t count as a “crime of violence” under federal law. If the court agrees? That death penalty charge could disappear.
Illegal Search, Tainted Evidence? Did The Feds Break The Rules?
But that’s not all — the legal team is also going after the evidence and claiming Mangione’s constitutional rights were violated. Apparently, when officers questioned him, they didn’t read him his Miranda rights and also searched his backpack without a warrant. That same backpack, by the way, reportedly had a gun and ammo inside. Mangione was captured in Altoona, PA — over 230 miles from the crime scene — after a McDonald’s tip led police straight to him five days after the murder. He’s been held without bail ever since.
